Terms of Service
These terms apply when you use the topbyte.app website or a Top Byte product. They are written in plain language on purpose. If a product publishes its own terms, those apply to that product and take priority where they differ from this page.
1. Who we are
Top Byte is an independent software studio. In these terms, "we" and "us" mean Top Byte, and "products" means the software and online services we publish, currently mindb and ShipRGB.

2. Who can use our products
- You must be old enough to enter into a contract where you live, or have the consent of a parent or guardian.
- We do not offer our products to children under 13.
- mindb accounts are not available to users under 14. Children can use mindb without an account, in which case their maps stay on their own device.
3. Accounts
- Keep your sign-in details to yourself. You are responsible for activity under your account.
- Tell us promptly if you believe someone else has used your account.
- You can delete your account at any time from inside the product. Deletion is described in the Privacy Policy.
4. Your content
- What you create with our products belongs to you.
- You give us permission to store, transmit, and process your content only as needed to provide the product to you, for example to sync it between your devices or to send it to an AI model when you ask for an AI feature.
- We do not sell your content, and we do not use it to train AI models.
- You are responsible for having the right to use anything you upload.
5. Acceptable use
You agree to follow the Acceptable Use Policy. In short: do not use our products to break the law, harm others, or interfere with the service.
6. AI features
- Some features send your input to third-party AI model providers and return generated output. Output produced by AI is labeled as such inside our products.
- AI output can be wrong, incomplete, or invented. Check it before relying on it.
- AI features have usage limits. Limits may differ between plans and may change.
- You are responsible for how you use AI output.
7. Paid plans
- Some products offer paid plans or credits. Prices, what is included, and the billing period are shown before you pay.
- Payments are processed by a third-party payment provider, which may act as the merchant of record. Their terms apply to the payment itself.
- Subscriptions renew automatically until you cancel. You can cancel at any time; access continues until the end of the period you have paid for.
- Refunds are described in the Refund Policy.
- If we change the price of a subscription, we tell you before the change applies to your next renewal.
8. Software you install
- Desktop software is licensed to you, not sold. You may install and use it on devices you own or control.
- You may not resell it, remove notices from it, or use it to build a competing hosted service.
- Our products include open-source components. Their licenses are listed inside each product and continue to apply to those components.
9. Availability and changes
- We work to keep our products running, but we do not promise uninterrupted service. Keep your own backups of anything important; our products provide export for this purpose.
- We may add, change, or remove features. If we retire a product or a feature that holds your data, we will give reasonable notice and a way to export your data first.
- We may update these terms. The date at the top of this page shows the latest version. If a change is significant, we will tell you inside the product or by email before it takes effect.
10. Ending your use
- You can stop using our products at any time.
- We may suspend or close an account that breaks these terms or puts other users or the service at risk. Where reasonable, we will warn you first and give you a chance to export your data.
11. Disclaimers
Our products are provided "as is". To the extent the law allows, we make no warranties beyond what is stated on this page, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limit of liability
To the extent the law allows, Top Byte is not liable for indirect, incidental, or consequential losses, or for lost data, profits, or business. Our total liability for any claim related to a product is limited to the amount you paid us for that product in the 12 months before the claim arose.
Nothing in these terms limits liability that cannot be limited by law, or removes rights that the consumer law of your country gives you.
13. Governing law
These terms are governed by the laws of the United States and of the state where Top Byte is established. We will first try to resolve any dispute by talking with you. If that fails, disputes go to the competent courts of that state, unless the consumer law of your country gives you the right to bring a claim where you live.
